ESG Investing by Fiduciaries and Other Emerging Topics

Integrating environmental, social, and governance (ESG) factors into investment decisions is increasingly an interest of the investment management community. Those who are fiduciaries working with retirement plans must understand the impact on their decisions and actions of the provisions of both the Uniform Prudent Investor Act and the Employee Retirement Income Security Act of 1974. This session will provide retirement professionals with a prudent road map which addresses this emerging topic.  Additionally, our speaker will give attendees an update on what is going on in Washington, D.C.

Attendees will:

  • Understand the two extreme positions regarding the law and economics in compliance with fiduciary responsibilities when considering an ESG investment program
  • Walk through a framework which documents the evaluation of the legal and risk-return factors that must be considered in their ESG investment decisions
  • Stay up-to-date with current events from our nation’s capital and how it impacts the retirement plan community.

About our Speaker Eugene F. Maloney, Esq.

Eugene F. Maloney is Executive Vice President, Corporate Counsel and a member of the Executive Committee of Federated Investors, Inc. Through Mr. Maloney’s efforts, Federated Investors is responsible for virtually all of the state legislation permitting public entities to use money market funds to manage their liquidity. Mr. Maloney has appeared as a speaker at American Bankers Association gatherings and is a frequent speaker at State Bankers Association meetings. He was an instructor in trust and securities law at Boston University School of Law for over 25 years, a visiting instructor at the Federal Financial Institutions Examination Council and the American Bankers Association’s National Graduate Trust School at Northwestern University, and participates in conferences that have been approved for continuing education credits for various legal, financial and advisor certifications.  In April, 2013, Gene received the Fiduciary of the Year Award from fi360 at their annual conference; fi360 is one of the top fiduciary oversight groups in the United States, and they are responsible for implementing the AIF (Accredited Investment Fiduciary) designation. Mr. Maloney has also served as an expert witness in both judicial and legislative settings on matters relating to fiduciary compensation, will construction, and prudent investing. Mr. Maloney received his B.A. from Holy Cross College in Worcester, Massachusetts, and his J.D. from Fordham Law School in New York City. He was an officer in the United States Army from 1969 to 1972 and served as an infantry officer for one year in the Republic of Vietnam.
